Neighbor issue with Satellite Dish?
I recently moved into a home. I saw a Satelite dish on the fence. I thought that it was left there from the previous owner. It was the middle of winter, so I figured. That I would remove it in the Spring. As the weather has gotten better. I noticed that the dish is actually the neighbors Satellite dish.
The installer had installed the Dish on my fence. My wife says that it isn’t a big deal. But should I remove the dish?
I am wondering about your use of the term “my fence”. Is it a fence on the property line? If so, it’s not all “your fence” – (even if you or the previous homeowner built and paid for it). The legality of a property line fence goes like this: Stand on your property facing the fence – the right half of that fence line is yours. The left half of that fence line belongs to the property owner on the other side of that fence. Keep in mind that this is the case ONLY in a property line fence, not a fence which does not sit on the property line. And, even though it may not seem fair, and even if that other property owner didn’t pay for it…..only half of the fence is yours. When building a fence on the property line, both property owners are responsible for paying their share. Often, though, one of the owners doesn’t need or want the fence and doesn’t pay…..and often the remaining owner ends up paying for the whole fence. But, this does not change the law concerning ownership of that fence.
So, having said that…..which half of the fence line is that satellite dish on? Your half or the neighbors? If it’s the neighbors, then you really don’t have a claim to it, nor the right to move it.
I can hear the arguments now. “That’s not right!” “That’s not fair” “She doesn’t know what she’s talking about!” Sorry, but that’s the way it is. I’ve had my share of boundary disputes in several states and learned this the hard way. (We are a Military family and move a LOT).
If the satellite dish is not on your neighbors half of the fence, but on yours…..decide with your wife whether or not it should be moved. Obviously, it bothers you. It would bother me, too. Do you know your neighbors well enough to guess if asking them to move the dish will cause disharmony between you. Good neighbors are a real treasure. You don’t realize that until you have bad neighbors.
